What is Liquor Liability?
Liquor Liability is insurance to protect a business from lawsuit claims that result from patrons becoming intoxicated and causing injury or damage including injury to themselves. Bars and restaurants are particularly at risk because of the added hazard of a patron driving drunk after being served liquor. A typical General Liability policy excludes liquor related occurrences from coverage. For added cost, some insurance companies will allow liquor liability to be added back as an optional coverage. In some cases, a separate Liquor Liability insurance policy will be required. Liquor liability insurance is normally priced based on total liquor sales.
Host Liquor Liability - This is the insurance coverage for a business or organization that is not a seller of liquor but might have incidental exposure to offering liquor. An example of events that might trigger this coverage would be a company holiday party or business seminar at which beer or wine was served. While liquor liability is normally excluded, some business insurance plans will offer Host Liquor Liability as an optional coverage.
Texas Alcoholic Beverage Commission (TABC) - This is the regulator agency in Texas that licenses establishments that offer liquor and enforces the rules for serving and selling liquor. Retaining your license to sell alcoholic beverages can be critical for any bar and for most restaurants. Most Liquor Liability policies also require compliance with the state rules for serving alcoholic drinks for coverage to apply. Procedures in serving any liquor should be written, consistent with TABC rules and enforced by management. All servers / sellers of liquor must have completed their TABC certification.
